When it comes to divorce, there are several terms and words that have quite a different meaning from actual English.
The law defines these words differently.
These terms are usually associated with a set of rules about what a person can do and cannot do.
The terms custody and visitation especially are the two most common terms and also the most misunderstood terms in a divorce.
A few decades ago, the custody of children was automatically given to the woman and the visitation rights to the man.
However, circumstances and views have changed over the last few years.
Research also indicates that when both the parents are equally involved in the children's lives, the overall impact is better and healthier.
Even dads are capable of taking perfectly good care of the children.
In the current times, custody of children is awarded to the parent who can take better care of the children.
Also, what is best for the children is taken into consideration by the court before making any decisions.
Custody means a parent gets to keep the children and visitation is the permission to visit the children.
The parent, who is not given the custody, is given visitation rights.
However, these are the two the most emotional terms that can actual cause miserable fights among couples.
Most legal battles in divorce cases are due to the custodial and visitation rights.
The points that are considered for custody are lifestyle of the parents, habits, alcoholism, use of drugs, violence, physical abuse, work schedule and least of all income and comforts.
Keeping all these factors in mind, the court works out a custody and visitation schedule for the divorced parents which they have to follow.
The parents, of course, have the right to appeal any judgment passed by the family court.
