Last Will & Testament Requirements

    Declaration of the Will

    • In the beginning of the will, there should be a declaration that the last will and testament is made by the particular individual. For instance, "John Doe, residing at XYZ Street, Anytown, XY, declares this to be his last will and testament."

    Disposition of Property

    • The next portion should contain how the person seeks to dispose of his property, and to whom the property should be given.

    Provisions Regarding Minors

    • A will should always contain a provision indicating what should happen in the event a minor inherits property under the will.

    Appointment of Executor

    • There should be a provision indicating who should serve as the executor of the will; the executor is the person who will handle the administration of the will.

    Signature

    • A will must always be signed by the person who made the will, and the signature must be performed in the presence of a notary public, witnessed and acknowledged. Every jurisdiction is different as to the number of witnesses, so it is crucial to determine the requirements of the particular state.
